Commission Regulation (EU) 2024/1328: Restrictions on Siloxanes D4, D5, and D6

New restriction will apply to octamethylcyclotetrasiloxane (D4), decamethylcyclopentasiloxane (D5) and dodecamethylcyclohexasiloxane (D6)

The European Union adopted Commission Regulation (EU) 2024/1328 on May 16, 2024, introducing new restrictions on octamethylcyclotetrasiloxane (D4), decamethylcyclopentasiloxane (D5), and dodecamethylcyclohexasiloxane (D6).
This regulation strengthens the existing limits on D4 and D5 in wash-off cosmetic products by also prohibiting the use of D6 in these products.
In addition, it restricts the use of D4, D5, and D6 as individual substances (excluding polymers) and as components of other consumer and professional products.

The regulation also limits their use as solvents in the dry cleaning of textiles, leather, and fur. For clarity, the measure replaces the previous entry 70 of Annex XVII to REACH in its entirety.

Restrictions for Cosmetics:

Cyclotetrasiloxane (D4):
Already banned in cosmetic products. Only technically unavoidable traces are tolerated at the maximum levels below:
– In wash-off products: already limited to max. 0.1%
– In leave-on products: max. 0.1% from June 6, 2027.

Cyclopentasiloxane (D5)
– In wash-off products: already limited to max. 0.1%
– In leave-on products: max. 0.1% from June 6, 2027.

Cyclohexasiloxane (D6)
– In wash-off products: max 0.1% from June 6, 2026.
– In leave-on products: max. 0.1% from June 6, 2027.

Why is the restriction complemented with a new restriction?

The European Chemicals Agency has identified D4, D5, and D6 as substances that possess highly persistent and bioaccumulative properties. Moreover, D4 has been found to exhibit persistent, bioaccumulative, and toxic properties, while D5 and D6 display these characteristics when they contain 0.1% or more of D4 by weight. The presence of these properties in consumer and professional products, which are eventually released into aquatic and atmospheric environments, raises specific concerns for the environment.

The draft amendment aims to minimize the release of D4, D5, and D6 from leave-on cosmetic products, as well as other consumer and professional products. Additionally, it strives to reduce the release of D6 from wash-off cosmetic products, all with the intention of safeguarding the environment.
