Who and what is a Responsible Person?

According to European regulation EC No. 1223/2009, each product placed on the market must have a Responsible Person. Here, we explain who they are and what their responsibilities are.

Who is a Responsible Person?

A Responsible Person is any EU based legal or natural person who acts as the exclusive representative of the product throughout the EU. Therefore, a responsible person does not always have to be a person, but it can also be a company.

What roles does a responsible person play in each product?

Their most important function is to make sure that the requirements of the EU cosmetics regulations are met before the cosmetic product is placed on the market, this is where SkinConsult helps you!

In short, the Responsible Person is involved in:
  • Compliance of product safety.
  • GMP guidelines.
  • CPNP registration as their information is made available to the EU commission on cosmetics safety.
  • Cosmetic labelling, the Responsible Person address must always be available on packaging (at least house-number, PO box and country).
  • Claims.
  • Communication of undesirable health effects (UHE), and taking immediate action if a problem occurs with the product.
  • Keeping a PIF for 10 years after the product is registered.
  • If the SCCS will give feedback on your product (e.g. for the use of nanomaterials), they will contact the Responsible Person.
